Official Rules

1. Eligibility: To be eligible for this Firelead, LLC. ("Firelead") contest, you must be at least 21 years of age, a current member of the Firelead website (http://www.firelead.com) in good standing as of May 15th, 2007 at 12 am EST. Full-time Firelead employees and members of their immediate families are not eligible for this contest. Firelead may reject any application for membership of the Firelead website that Firelead determines, in its sole and absolute discretion, fails to meet any of these eligibility requirements. To be eligible you must agree to abide by these terms and conditions and be bound by all Firelead decisions relating to this contest, which are final and binding in all respects, including but not limited to Firelead’s determination of the winners.

2. Duration: The contest begins on Tuesday, May 15th, 2007 at 12 am EST and ends on Friday, June 15th, 2007 at 1 pm EST.

3. Prize Criteria: You must earn over $500 in commissions during the duration of the contest to be eligible for the grand prize drawing. The Prize winner will be required to complete and submit the Affidavit of Eligibility provided by Firelead. If a Prize winner fails to complete and submit the Affidavit of Eligibility as specified above within ten (10) days of Prize notification, or if a Prize winner is disqualified or held to be ineligible in the sole discretion of Firelead, the corresponding Prize will be awarded to another participant chosen in the same manner as the initial prize winner.

4. Prize Date: The winner of the contest will be posted on the Firelead website on Friday, June 15th, 2007. If the winner does not want to be disclosed, Firelead will post their initials by request only.

5. Prizes: There is a total of 1 prize to be awarded. The winner will be determined by random drawing moderated by a third party who is not a participant in the contest.

6. Restrictions: This contest is void where prohibited or restricted by any relevant federal, state or local law, including but not limited to jurisdictions with laws that would require registration, disclosure, filing, trust account or posting of a bond, or any other requirements that are not satisfied.

7. Limitation on Liability: Notwithstanding anything to the contrary, neither Firelead, nor any supplier, employee, director or agent shall be liable under any legal or equitable theory for (a) any technical or human error which may occur in the process of earning commissions in Firelead that may limit your ability to participate in this contest, (b) failure of your submission to be included in the contest, or (c) any injuries, losses or damages caused by a Prize awarded (or failed to be awarded) in the contest or participation in the contest.

8. Warranty Disclaimer: The Prize is provided on an ‘AS IS’ basis, and Firelead disclaims all warranties, express or implied, or to any other subject matter of these terms and conditions.

9. Release and Publicity: If you agree to accept the grand prize and accept publicity for winning the grand prize, you forever release and grant Firelead the right to use and disclose your name in connection with the Firelead website or any Firelead promotion of the contest results or related publicity, including, without limitation, a press release. You acknowledge and agree that Firelead is granted a non-exclusive, worldwide, royalty-free, transferable right to display, perform, use, reproduce, modify, distribute and provide users access to all Animations (including all related intellectual property rights) in connection with the Firelead services and Firelead website.

10. Assignment: The Prizes are not assignable or transferable by you without written consent from Firelead. Firelead may freely assign and delegate its obligations hereunder.

11. Other Terms: Firelead is the sole sponsor of this contest. This contest is governed by the laws of the State of Pennsylvania, USA, without regard to its conflict of laws provisions. The parties irrevocably consent to exclusive jurisdiction and venue in the state and federal courts of Pittsburgh, Pennsylvania. If any provision of these terms and conditions is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law. Firelead reserves the right, at its sole discretion, to disqualify any individual found tampering or otherwise interfering with the contest. If Firelead determines, in its sole discretion, that the contest is compromised by any corruption of the administration, security, or proper play of this contest then, at Firelead’s sole discretion, it may cancel the contest without further liability on the part of Firelead. The winner will be subject to, and responsible for, all applicable U.S. taxes and withholding. The successful winner of the contest will be responsible for reporting their winning to the appropriate federal and state taxing agencies. The retail value of the prize is $250.00 USD. The odds of winning depend on the number of eligible affiliates participating on the award date. No purchase of any item or contestant fee is required for entry into this contest. All entries received by Firelead will be held for twelve months following the announcement of the winner and are the property of Firelead once submitted. Only one entry per contestant please and all misdirected, lost, late applications, printing or typographical errors shall be the fault of the contestant and such errors may disqualify the contestant in the sole discretion of Firelead.
